Contracts

At the heart of any property transaction is the contract, which lays out the terms and conditions of the sale which will be agreed upon by both buyer and seller. An experienced conveyancing solicitor is needed to draft such a contract, as well as checking it thoroughly on the buyer’s side. There may also need to be negotiation and compromise on the terms of the contract before an exchange of contracts can take place.

Searches and Checks

If you’re purchasing a property we will conduct certain searches and checks on your behalf. These include Local Authority searches which investigate the property’s boundaries, rights of way, planning constraints or permissions and any disputes. Other searches include environmental, water, drainage and land charges, as well as any other checks you may wish to have carried out.

Exchanging Contracts

When everyone’s happy with the terms of the contract, conveyancing solicitors on both sides will set a date to exchange contracts. On this date, both parties are committed to the transaction.

Completion

This is one of the most important dates of any property transaction, when the property purchase is completed. Between the date of exchanging contracts and completing, a solicitor can help with any last financial checks and set the date for completion. On this crucial day, the services of a solicitor are essential as everything needs to happen at exactly the right time. Your conveyancer can handle the transfer of funds to pay the balance of the purchase price and, once the keys have been handed over, register the purchase with the Land Registry on your behalf. They can also arrange for stamp duty (if applicable) to be paid.

The Conveyancing Process Explained

Conveyancing follows a series of well-defined steps, from accepting an offer to handing over keys on completion day. The initial step involves instructing a conveyancing solicitor to manage the transaction. Engaging a conveyancer early can identify potential issues and strengthen the buyer’s negotiation position by addressing legal concerns upfront.

Key stages include conducting essential property searches to uncover potential issues, such as title checks and planning searches related to commercial property. The seller’s solicitor prepares a draft contract, which the buyer’s solicitor reviews and raises necessary enquiries. Exchanging contracts legally binds both parties.

The period between exchange of contracts and completion finalizes all legal and financial arrangements. On completion day, the buyer’s solicitor transfers purchase funds to the seller’s solicitor, and the keys are handed over.

Although a chain-free purchase accelerates the process, various factors can still cause delays, such as surveys and document issues. Typically, a no-chain transaction can be completed in approximately four to six weeks.

Types of Property Searches Conducted by Athi Law

Athi Law performs various property searches to understand potential issues thoroughly. These include Local Authority searches, environmental searches, and water and drainage checks. Local Authority searches uncover any planning issues and restrictions that may impact the property.

Environmental searches evaluate risks such as pollution, flooding, and historical contamination, ensuring the property’s safety. Water and drainage searches verify the property’s connection to public water supply and sewer systems, crucial for functionality.

Conducting these searches provides peace of mind and helps avoid potential future problems.

Role of a Conveyancing Solicitor in Contract Negotiation

Conveyancing solicitors and property lawyers are pivotal in negotiating contract terms, ensuring their client’s interests are well-represented. They draft and review contracts to identify potential issues or risks before finalization. During negotiations, solicitors address specific concerns from either party, facilitating smoother transactions.

Adhering to local regulations throughout contract negotiation protects the client’s legal standing. A knowledgeable solicitor offers strategic advice to improve contract terms, enhancing the client’s position. This thorough approach ensures all aspects of the contract are favorable and legally sound.

Completion Day: What to Expect

Completion day marks the official transfer of property ownership from seller to buyer. The buyer’s solicitor transfers the final purchase price to the seller’s solicitor, usually requiring prompt action, with completion often finalized by midday.

Once the seller’s solicitor confirms receipt of funds, the estate agent hands over the keys to the buyer. The buyer’s solicitor then registers the new ownership with the Land Registry and settles any existing mortgages on the property.

For those involved in a property chain, all transactions need to complete on the same day, which can complicate the process.
